I'm actually curious as to whether she has a credible argument on the constitutionality (or lack thereof really) of such punishment for such crimes or if she is simply using the word as a magical incantation. I mean I think I could construct such an argument, but I am doubtful it would prevail when fully tested in the court system. I have a feeling she has no clue and just thinks using those words gives her feelings power.

Cruel and unusual punishment. 8th amendment. We don't mutilate people for any other crime so it's definitely unusual. With the way the public is easily whipped into a fury over sex crimes, giving the government the power to castrate people because a mother dislikes someone and invented a story is incredibly dangerous.
