You should check your local laws on wiretapping and see if it similar to that of DC http://www.dmlp.org/legal-guide/district-columbia-recording-law whereby only one party in the phone conversation needs to give permission for a call to be recorded (ie you can record without consent of the other person if you make the call in DC). If wherever you live has the same one party consent law then you do not need his permission to record.
