Per penal code 9.41 (protection of one's own property), you can use force to prevent or terminate someone's trespass on your property, but 9.42 (deadly force to protect property) does not provide a condition for using deadly force related to trespass. However there are many conditions under 9.31 (self-defense) and 9.32 (deadly force in defense of person) that would likely cover actions in total.
Basically, you'd need to confront them in a way that is not illegal or provoking (not necessarily face to face, but shining a light on them or yelling at them to stop and leave). If they raised their rifles or took any other action that any reasonable person could interpret as a threat, you'd be legally justified in shooting them. Or if a reasonable person would believe that they were attempting to commit murder (which probably wouldn't be a high standard when considering an armed cartel platoon). But you could not snipe them just for being present on your land with a rifle (though it's a different case for being in your home, car, or place of business - in which case it is shoot first and think about asking questions later).

Because it's reasonable to assume they are cartel and will kill you if confronted. Fearing for your life is all you need in court to justify killing the trespasser. It's cut and dry of they are armed and in military gear and carrying drugs. Even if they aren't, all you have to say is he was reaching for a weapon and I was scared for my life.
I don't think it would be as easy a case to make as you think it would be. I really HOPE it would be, since we here all know what kind of stuff they're there to do. But I think it would get muddled fast if it came to a court case. And keep in mind that I'm more talking about the difference between running away and sniping them from your LP/OP. There's a wide range in there that probably contains all the scenarios we have in our heads right now.

A group of unarmed trespassers being sniped from the LP/OP would be a tough sell, especially if you are on social media talking about hunting illegals, as that would indicate intent to murder indiscriminately. In practice, however, that is a lottery ticket court case. The average scenario would be someone shooting AT trespassers and either running them off or detaining them until authorities show up. A severe case would be when the trespasser shoots back, in which case, shooting from the LP/OP or a defensible position on your land would likely make you the victor, even in court. Ballistics would indicate that there was a gun battle, and the house always wins.
Though in retrospect, if the trespassers are armed and the land owner plinks them from a sniper position, I still believe the justification for shooting them is warranted in Texas. Especially if the "victims" are convicted felons or known cartel members. Your punishment will likely be not being able to sleep at night because the cartel will come and find you later. I do know a lot of incidents where people have been shot while trespassing on private land in Texas. Convictions are surprisingly rare. Though, the shootings usually happen from within a reasonably distance, usually within earshot and visually identifiable range.
I think the only scenario where a ranch owner goes to jail is exactly that LP/OP scenario and he is plinking unarmed border crossers. The prosecution is likely to find anti-immigrant rhetoric and build a case on premeditation, like with the Charleston driver.

It's all dependent on the scenario. A group of unarmed trespassers being sniped from the LP/OP would be a tough sell, especially if you are on social media talking about hunting illegals, as that would indicate intent to murder indiscriminately. In practice, however, that is a lottery ticket court case. The average scenario would be someone shooting AT trespassers and either running them off or detaining them until authorities show up. A severe case would be when the trespasser shoots back, in which case, shooting from the LP/OP or a defensible position on your land would likely make you the victor, even in court. Ballistics would indicate that there was a gun battle, and the house always wins.
Though in retrospect, if the trespassers are armed and the land owner plinks them from a sniper position, I still believe the justification for shooting them is warranted in Texas. Especially if the "victims" are convicted felons or known cartel members. Your punishment will likely be not being able to sleep at night because the cartel will come and find you later. I do know a lot of incidents where people have been shot while trespassing on private land in Texas. Convictions are surprisingly rare. Though, the shootings usually happen from within a reasonably distance, usually within earshot and visually identifiable range.
I think the only scenario where a ranch owner goes to jail is exactly that LP/OP scenario and he is plinking unarmed border crossers. The prosecution is likely to find anti-immigrant rhetoric and build a case on premeditation, like with the Charleston driver.

Homestead is homestead, your home and curtilage are inviolate. Convictions around that would have to include cases where no element of other crime, such as cases where someone is confused, goes to the wrong house, and expresses intent to leave when confronted. But with the seven deadly crimes including "criminal mischief" (basically vandalism and general asshattery), proving that can be something of a burden on the prosecution.
In the end, we're probably thinking pretty much the same thing.
