The former head of the Anti-Discrimination Board, Chris Puplick, could face criminal charges for allegedly helping a friend lodge a complaint with the board and withholding evidence from the NSW Ombudsman.
The Ombudsman, Bruce Barbour, referred Mr Puplick to the Director of Public Prosecutions and the Independent Commission Against Corruption, according to his annual report.
The report details complaints against the Government and the Ombudsman's investigations.
It outlines allegations that Mr Puplick helped a friend file a breach of privacy complaint against his employer. The report says Mr Puplick dined and travelled with the man - referred to as Bunny - while the board pursued the complaint, but did not inform his staff about the potential conflict of interest.
It says Mr Puplick emailed the man and told him he had instructed his staff to give the complaints "some priority".
It also alleges the man accepted a $6000 settlement from his employer, and was later able to repay Mr Puplick money he owed him.
The report says Mr Puplick acted foolishly, unreasonably and unjustly. It also found he had other conflicts of interest as head of the Privacy Commission and chairman of the Central Sydney Area Health Service.
"His role in the complaints was unfair to the employer, who could rightly apprehend bias on Mr Puplick's part," the report says. "Our investigation found Mr Puplick had a poor grasp of conflicts of interests and had repeatedly failed to manage both actual and perceived conflicts arising from his professional roles and friendships."
Mr Puplick stood down as the board's president and as Privacy Commissioner when the Ombudsman's first report was made public in May, and the matter was referred to the DPP. Days later he resigned as chairman of the Central Sydney Area Health Service.
But a spokesman for the Ombudsman said the decision to refer the matter to ICAC was not made until new information came to light that Mr Puplick had gone as far as drafting Bunny's complaint.
The Ombudsman's report claims this information is at odds with Mr Puplick's sworn evidence and submissions. "The DPP needed more information and ICAC has capacity to investigate," the spokesman said.
Mr Puplick made headlines the day before the original revelations, when the Premier, Bob Carr, attacked in Parliament a report he prepared on racism in Australia as "contentious, ideological claptrap".
Mr Puplick could not be contacted and Mr Barbour was unavailable. Mr Barbour said previously that over the past year written complaints to his office about government bodies had increased by 12 per cent, and oral complaints by 5 per cent.
The largest number of complaints were about customer service, followed by objections to decisions. He said public agencies should be more willing to apologise and compensate for mistakes.
He said that when they make mistakes public agencies should put people back in the position they would have been in had the mistake not occurred.
"If that is not possible I expect agencies to consider other options," he said.

The claim, first published by The Daily Telegraph, was also the subject of an ombudsman report earlier this year. Puplick resigned as ADB president in May but issued a statement rejecting any implication that he acted improperly. In that statement, Puplick said the email record which had formed the basis of the Daily Telegraph story had been seriously misconstrued and that a number of false implications have been read into it. The executive officer of the AIDS Trust, Terry Trethowan, said no decision had been yet made about Puplick’s position as the chair of the board of governors while he faces the ICAC enquiry.

A day after Carr’s remarks the Australian and Daily Telegraph published two private emails written by Puplick. The newspapers used the letters to accuse the ADB president of “conflict of interest” in a gay harassment case. While Carr claimed that his parliamentary diatribe had nothing to do with the email revelations, the timing was extraordinarily coincidental.

NSW Anti-Discrimination Board president Chris Puplick yesterday resigned after allegations that he helped a friend in a workplace complaint to the board.
Mr Puplick denied he had acted improperly, but admitted he had erred in sending an email about the case. He said his resignation was to protect the board's reputation. He also resigned as Privacy Commissioner.
NSW Attorney-General Bob Debus said he accepted Mr Puplick's resignation after it was revealed the NSW Ombudsman was investigating allegations of a conflict of interest.
The allegations related to a workplace gay victimisation complaint that a friend of Mr Puplick's lodged with the anti-discrimination board against a media company chief executive in March 2000.
Mr Puplick, a former federal Liberal senator, denied acting improperly in the case, in which he said his impartiality and integrity had been questioned.
But he said: "An email sent by me, which I admit should not have been sent in the terms it was, has been seriously misconstrued."
