The "anchor baby" interpretation (i.e., if born on U.S. soil, automatically a U.S. citizen) of the 14th Amendment is a tortured twist of a provision that was meant to apply to children of slaves who were not subject to the jurisdiction of any other country and therefore were 100% U.S. citizens.
If birth is all it takes to qualify to run for the highest office of the land, Putin (Russia) and Xi (Communist China) could (and likely do) send pregnant women over here, put them up in hotels/homes until they give birth to "American citizens," bring mother and child home to their own countries and then send the indoctrinated child back here as an adult to run for President as "natural born."
There is a distinction between "natural" and "native" born and maybe that will come into play in a future case.
There is no Supreme Court case directly on point yet.
Dual loyalties are what the Constitutional requirement for birthright citizenship in the 14th Amendment protected against by saying: "...and subject to the jurisdicton thereof."
Socialists and others intent on destoying America and ignoring law and order always leave that limiting phrase out.
Many countries grant children of their citizens automatic citizenship, no matter where in the world they are born. So when a child is born on U.S. soil to a parent of foreign citizenship, that child is a citizen of another country. He or she may go through the hoops of becoming an American citizen but should not be considered a citizen simply by virtue of his or her mother being on U.S. soil, legally or otherwise, at the time of his or her birth.
This bastardized application of our laws to create "anchor baby citizenship" is what:
- puts our country at a national security risk,
- has blossomed a huge "birth citizenship tourism" industry,
- puts pregant women at risk - drawn like a magnet by the policy - who make dangerous illegal border crossings while pregnant,
- puts women flying late term from foreign lands at risk (again drawn by a twisted interpretation of the 14th Amendment).
It's time to clarify the very abused "anchor baby" principle by stating clearly what the 14th Amendment meant - as opposed to how it is being applied.
No "anchor baby" citizenship.
