No kids were abducted in this video and I am not a lawyer, nor did I watch all of this, but this comment on youtube states the law. The guy arrested may not have actually known what the law is. And he probably can be charged with a legit resisting arrest charge. I'm not going to tell you my name is not some magic card of protection that halts police in their tracks. The police can still detain you as your wait for your lawyer. The cop probably could have explained himself better, but police are allowed to use force against someone resisting arrest.
1) For God's sake - SHUT UP (hire an attorney and let them talk). 2) FL law requires those suspected of a crime identify themselves. 3) Never, never, never resist. LEOs learn early on how to provoke people into resisting, don't be a sucker. The obstruction charge will stick and will probably get additional charges as well. If you refuse to comply (and you should) KNOW THE LAW.
Florida’s stop and frisk law permits a law enforcement officer to stop and temporarily detain a person and request identification if the officer has a reasonable suspicion that the person has committed, is committing, or is about to commit a crime. But wait, you say – isn’t it a violation of my civil rights for the police to detain me without probable cause to arrest me? Unfortunately, no.
1.Ask the cop "Why are you questioning me ?"
2.When he starts to ask questions say "Respectfully, I don't feel like discussing my day" 3. ask "Am i being detained or am I free to go ?" And 4. If detained plead the 5th an shut the fuck up.
They are trained to ask loaded questions & tricking you into giving up your rights.
Same with CPS workers. Most of their reasoning for removing a child comes from statements the parents make or what they see when they are allowed into the home. Never allow them in without a warrant
