Pizzagate relevant because many, if not all, of these 12 individuals are members of the Deep State who we have been trying to bring down for crimes of pedophilia.
The most common reason for sealing an indictment is the need to avoid tipping off the defendant (in this case, all 12 of them) who might otherwise become fugitives. Another reason is to keep an indictment out of the media spotlight for as long as possible. The SOL (statute of limitations) is tolled, so the filing under seal is not needed to obtain a SOL benefit. It is unsealed when the government feels that it is appropriate to do so and/or until an arrest is made.
David Schulz, an attorney who has represented the NYT in efforts to unseal court documents once stated:
"It's a very troubling trend. We don't have a system of secret justice in this country, but it seems like more-and-more things are happening behind closed doors."
In recent years, the number of cases involving court documents filed under seal has increased dramatically.
What about expungement for felony convictions after a waiting period? Expungement is the process of getting your criminal records sealed, destroyed, or cleared.
At the federal level, there is no overreaching federal staute governing whether courts may grant expungement orders. A patchwork of statutes governs the rules for the expungement of records in "special circumstances." Expungement is not based on the type of crime committed, but in which circuit the crime is committed. For example, at the federal level = FBI, which raises the question of whether courts have the power to expunge executive branch records.
While there is no uniform process known as expungement, it is commonly accepted that the purpose of it is to conceal criminal records from the public by destroying, erasing, or by sealing arrest or conviction records.
In the District of Columbia, one can petition to have their criminal records sealed if you can show that you were innocent of the crime for which you were arrested OR charged.
Let us just all pray that this is not another drawn-out waiting game and that arrests are made swiftly and soon.
