It's willful avoidance, but the motive is wrong. They literally can't do anything about it now, but after Trump is in office they likely can. The idea is to keep a lid on it, boiling below the surface, until they can strike. If it blows up too soon it gives the opportunity for the current corrupt justice department/executive branch to run a cover up.
