It has not been ruled upon by the Supreme Court of the US but the prevailing wisdom is that a sitting POTUS cannot be indicted. Simply speaking, his duties are too important to open him to indictment - for instance a political rival could arrange indictment simply for political reasons. Think of all the other scenarios that could be alledged (foreign countries, domestic disorder, EO’s, on and on.)

The POTUS does have power to pardon himself but first the above would have to happen. Since this has never come up it’s never been ruled on by SCOTUS either.

The job is too important to have POTUS personally bogged down in court.

Impeachment by the House and conviction by the Senate is the process to remove the POTUS for high crimes and misdemeanors...And of course not re-electing the same POTUS.

Trump can’t be indicted while in office and after he is out there would be no political motivation to do so (for things he did while in office).

While Trump is in power, he is too powerful to go after his family and I think the established thought would be that these are things that we do not want POTUS dealing with (family problems-whatever) while in office.

Trump could pardon anyone in his family. BC pardoned his own brother. So it would be pointless.

In 1872, President Ulysses S. Grant was arrested for speeding on his horse-drawn carriage in Washington, DC. This was not an impeachable offense, but Grant still faced consequences.

Grant, the general who helped lead the Union to victory in the Civil War, was arrested at the corner of 13th and M streets in the nation's capital. The story of his arrest was once told in a September 27, 1908, edition of the Washington Evening Star with the headline: "Only Policeman Who Ever Arrested a President."

The police officer who arrested him was a black man who fought in the Civil War named William H. West, who gave his account of the incident to The Star, which The Post dug up.

Grant apparently had a penchant for speeding and a love for fast horses and had more than one run-in with West.

On the first occasion, the president was somewhat sassy with the officer as he stopped his carriage. The city was having problems with speeding at the time, and a mother and child had recently been injured as a result.

A sitting President would not likely be arrested for a crime. There are two reasons for this. First is simple: the circumstances of the Presidency pretty much limit a situation that would, for example, see the President commit murder, rape, or other violent crimes that would demand immediate arrest.

The Argument Against Arrest

But it goes farther than that. There are no Constitutional or Federal statues that prevent the President from being arrested, indicted, or prosecuted. But there are “structural principles” in the Constitution that should at the least suggest that a President should not be arrested, possibly not even prosecuted.

I was fascinated by it. I guess people back then were use to it. It looks like some people almost got hit. They drove slower then, so nothing happened, but it came close. I laughed a couple of times. It's hard to imagine the changes in our world. It looks so different from the way things are now.
