I hope 10% is right, but I never let my guard down on this kind of thing. Coming out strong against these senators when there are still low levels of support might send a message that they'd best wait 5 years instead of 6 months to try again. I think something like that is about the biggest win you can have in a system like ours.

10% chance of passing. Problem is that they'll keep introducing it over and over until it passes. Not this year, probably not next, but eventually.
They're probably looking for or to create an excuse, just like 9/11 pushed through the "Patriot" Act.
