Isn’t this sort of a win-win?

If they release it - win. Clintons and other politicos go down.

If they are criminally prosecuted - win. FBI and DOJ are cleaned.

Sure it should be both but either one might end up unraveling the other anyway if managed correctly.

If it's leaked, it reduces its efficacy as evidence in a court.

What are the rules for using it in MT? That's where it would apply. Not civilian courts.

PutinsPenthouse ago

The rules are it's absolutely illegal to try this in a military court and nothing that's happened since Trump became president has changed that one whit.

NoRoyalty ago

You are wrong on that. There are specific instances cited in the code for trying citizens in military tribunals. An important qualification is about to be announced and the left (leaders) are freaked out about that.

PutinsPenthouse ago

Nope. I'm completely correct on that. There are specific instances for trying citizens in military tribunals and they are very, very limited. Every you ever actually read the code? It would not apply to 99.99 % of civilian crimes.

See here.

You left out at least one important permitted application. I don't have time right now but I assure you that the shutdown of our courts is one of them. Guess what? The court system has basically run out of money due to the partial govt shutdown. It pays to complete your research.

PutinsPenthouse ago

Yeah, that's completely false. It's not the shutdown of the courts, it's the inability to function. That's for things like periods of insurrection.

The Federal Courts are considered essential and due to the Anti Deficiency Act will remain operational during a government shutdown. Here's a letter from a previous shutdown explaining what would take place.

Sorry, but "nonfunctional" is the definition of courts which are not functioning because they are closed.

Qisforquackery ago

which I just pointed out will not happen with the Federal Courts. They are considered an essential act of government because they are defined in the Consitution and they will not close.

lol.
